Understanding Arizona's DUI Penalties

Arizona is known for having some of the strictest DUI laws in the United States. The penalties for a DUI conviction vary based on your blood alcohol concentration (BAC), prior offenses, and aggravating factors. Understanding these penalties is essential for anyone facing DUI charges.

First-Offense DUI (BAC 0.08 to 0.14)

A first-offense DUI in Arizona is a Class 1 misdemeanor. Penalties include a minimum of 10 days in jail (with 9 days potentially suspended), fines and fees totaling approximately $1,500, license suspension for 90 days, and an ignition interlock device for 12 months. You may also be required to attend alcohol education classes.

Extreme DUI (BAC 0.15 or Higher)

An extreme DUI carries harsher penalties. For a first extreme DUI, you face a minimum of 30 days in jail, fines and fees exceeding $3,000, license suspension for 90 days, and an ignition interlock device for 12 months. The mandatory minimum jail time increases with higher BAC levels.

Super Extreme DUI (BAC 0.20 or Higher)

A super extreme DUI is charged when your BAC is 0.20 or higher. The penalties include a minimum of 45 days in jail, significantly higher fines, and longer ignition interlock requirements. Judges have limited discretion to reduce these mandatory minimums.

Aggravated DUI (Felony)

An aggravated DUI is a Class 4 felony. It applies when you have a prior DUI within the past 84 months, were driving with a suspended or revoked license, had a child under 15 in the vehicle, or were required to have an ignition interlock device. Penalties include prison time, substantial fines, and a 3-year license revocation.

Defending Against DUI Charges

Despite the severe penalties, there are many defenses available in a DUI case. We can challenge the legality of the traffic stop, the accuracy of field sobriety tests, the calibration of breathalyzer equipment, and the handling of blood samples. Every detail matters.
